Fire risks equal heavy fines

* Businesses should take note of the misfortune of Shell UK and a breach of fire regulations which recently led to them being fined at the Inner London Crown Court the sum of £300,000 together with a costs order of £45,000 following two small fires at their London offices.

Following the fire an inspection showed a number of breaches of fire regulations which included blocked fire escapes and defective fire doors and this led to a Prosecution brought by the London Fire Brigade and the largest fine of its kind so far under the Regulatory Reform (Fire Safety) Order 2005.

Mark Proctor says “The level of fine imposed by the Courts sends out a clear message just how seriously such breaches of regulation will be taken. In light of this judgement businesses should be careful to review their own fire procedures and polices and ensure these are being complied with”

Indian restaurant owner ordered to pay over £4,000 for FSO breaches

The owner of an Indian restaurant in Gloucestershire has been ordered to pay over £4,000 after admitting to breaches of the Regulatory Reform (Fire Safety) Order 2005.

Abdul Hamid Choudhury was fined £2,900 and ordered to pay costs of £1,500, along with a £15 victim surcharge, after fire safety inspectors found multiple breaches, including the lack of a sufficiently completed fire risk assessment (FRA). The breaches were discovered after a fire at the premises on November 6th 2009.

Richard Smith, the senior fire safety enforcement officer at Gloucestershire Fire and Rescue Service, noted that an FRA - which is compulsory under the Regulatory Reform (Fire Safety) Order 2005 - would have increased levels of fire safety.

"If a fire risk assessment had been carried out, it would have identified the measures required to make the premises safe such as a fire alarm, emergency lighting, fire doors and staff training," he said.

The Regulatory Reform (Fire Safety) Order 2005 applies to the communal areas of houses of multiple occupancy (HMOs) and all commercial properties in England and Wales.
